Client awarded six figures in personal injury case
Mark Harper recently won a difficult slip-and-fall case against MARTA in Fulton County Superior Court. In this case, the Client sustained a serious knee injury when he slipped and fell on gravel at a MARTA station. The transit system's maintenance crew had spread the sand and gravel to provide traction for the buses in icy weather. Because the Client had passed the site numerous times, the defense argued equal or superior knowledge by the Client. The theory of the case was that MARTA protocol required the gravel be removed as soon as the weather improved because the gravel was itself a hazard. Because this was not done, the jury awarded the Client $125,000 to compensate for his injury.
